Memorandum of understanding between the government and the opposition

Realizing the responsibility to the Ukrainian people in the time of a political crisis dangerous to the country’s future, we consider it our patriotic duty to start a constructive dialogue between the opposition and the government now. The contents of this dialogue are joint development of strategy to overcome the crisis and placing Ukraine on the road to building a prosperous society, the road of civil reconciliation, and consolidation of state-oriented political forces.

We view this Memorandum’s clauses as filling the executed “Declaration of unification and cooperation for the future of Ukraine” with concrete contents, the mechanism for fulfilling the Declaration, as a step in the matter of coming to understanding over divisions, as our desire for constructive dialogue to the benefit of the Ukrainian people.

Thus, we consider the following necessary and agree on:

1.Introduction of political reforms;

2.Disallowing of political repression against the opposition;

3.Introduction of the draft Law of Ukraine «On amnesty» and inclusion therein Arts. 157 and ст.158 of the Criminal Code of Ukraine;*

4.Urgent enaction of the Law on introduction of changes to the Law of Ukraine «On the status of local council members » which envisages legislative regulation of the procedure for prosecution of members of local councils;

5.Acceleration of adopting the Law of Ukraine «On the status and rights of opposition» (with opposition’s chairing over the following parliamentary committees having been secured: freedom of speech and information; budget; anti-organized crime and anti-corruption; and Special Auditing Commission of the Verkhovna Rada of Ukraine for privatization);

6.Acceleration of adopting the Laws of Ukraine «On the Cabinet of Ministers of Ukraine», «On the President of Ukraine»;

7.Transparent formation of the Government on the principles of professionalism and separation of government and business;

8.Legislative regulation of ownership rights guarantees;

9.Disallowing of pressuring of court agencies;

10.Non-interference of the state agencies and appointed officials into preparation and conducting of elections of the members of Verkhovna Rada (Parliament) of Ukraine, members of local and village, township, and city councils on 26 March 2006, not using the administrative resources;

Complete and unconditional execution of the signed agreements evidences the possibility of consensus between the state and the opposition, the ability to put the people’s interests before own ambitions.
